On Mar 15, 2017, “Open Talk” forum was successfully held by SAGW (Shanghai Automobile Gear Works Co., LTD), the wholly-owned subsidiary of SAIC (SAIC Motor Co., LTD). As delegates of RICCO & CO’s Centre for Anti-Corruption, Attorney Wang Yinping and Attorney Zhang Xuan were invited to attend the forum and delivered presentations about how to strengthen the internal control and fraud prevention for technology driven companies. Not only did all the staff in SAWG Shanghai Office attend the forum, but also staff in other cities like Yan Tai and Liu Zhou listened in on the speech through remote live broadcasting.
In the forum, Attorney Zhang Xuan introduced the definition, standard and protection of the “Business Secret”. “From the point of a technology driven company”, he emphasized, “If a company has already taken measures and invested in manpower and resources to protect or process the information, then it is endowed with ‘additional value’, which means that it can be recognized by the court as ‘business secret’, even though the similar information is still available in a public way (That is to say the information is not completely secret).” Meanwhile, Attorney Zhang Xuan also recommended the solutions to handle the relationship between leaving staff and the business secret he/she had engaged before.
